Rights of owners

As the owner of your personal data, you have the right to:

  • Access free of charge to the data provided that have been subject to processing.
  • Know, update and rectify your information in case of partial, inaccurate, incomplete, fractioned or erroneous data.
  • Request proof of the authorization granted.
  • File complaints before the Superintendence of Industry and Commerce (SIC) for violations of current regulations.
  • To revoke the authorization and/or request the deletion of the data, provided that there is no legal or contractual obligation that prevents their deletion.
  • Refrain from answering questions about sensitive data.

Procedure for the exercise of rights

The holder or his representative may submit requests, queries or claims related to the processing of his personal data.

The Foundation will respond to requests within the deadlines established in Law 1581 of 2012:

Inquiries: Within ten (10) business days of receipt.

Claims: Within fifteen (15) business days of receipt.

If the request requires more time, the holder will be informed of the reason for the delay and the new response date.

General Provisions

Permanent measures

In the processing of personal data, the Foundation will permanently verify that the right of habeas data is guaranteed to the owners.

Regulatory compliance

The Foundation will carry out the registration of the databases before the National Registry of Databases (RNBD) in accordance with Decree 090 of 2018 and Decree 1074 of 2015.

Validity and updating

The databases will be kept as long as the contractual relationship with the holder is maintained or as long as their deletion is not requested, provided that there is no legal duty to keep them.

Time of attention

The Marina Orth Foundation will respond to the requests of the holders within the legal deadlines. If the request cannot be resolved within the initial term, the applicant will be informed of the reason and the new deadline for response.

Processing purposes according to type of owner

Beneficiaries

The Marina Orth Foundation will collect, store and use the personal information of beneficiaries for the following purposes:

  1. To send communications at a general level.
  2. Maintain historical, scientific or statistical records.
  3. Generate internal statistics.
  4. To comply with the attention of citizens' rights.
  5. To manage extraordinary aid from the public administration.
  6. Manage social assistance activities.
  7. Proof of donation.

Data processing of minors:The protection of their prevailing rights is guaranteed, requiring the authorization of their parents or legal representatives.

Assignment of audiovisual rights:In case of participation in institutional activities, the holder authorizes the use of his image, voice or videos by the means permitted by law, without financial compensation.

Referenced data:If third party data is provided, the holder declares that he/she has their express authorization.
